All products sold by New Elements Srl, owner and producer of the Zuelements brand, are covered by the legal warranty of 24 months of the seller provided for by Legislative Decree no. 206/2005 ("Consumer Code"). Pursuant to Articles 128 to 135 of the Consumer Code, the consumer has the right, among others, to obtain from the seller the free repair or replacement of products that show a lack of conformity in the 24 months following the delivery date. The defect must be reported within 2 months of discovery.
Description of the Legal Warranty.
The Legal Guarantee is the warranty on the sale of consumer goods provided for in the Community Directive 1999/44 / EC, also known as "conformity guarantee", which protects the consumer in the event that the purchased products show conformity defects compared to the contract of sale ("Legal Warranty").
Who has the right to request the application of the legal guarantee in accordance with the Consumer Code?
The Legal Guarantee is the right of the consumer only, ie those who buy products for non-professional purposes.
Against whom can the Legal Guarantee be asserted?
The consumer can assert the legal guarantee against the person who sold the product, even if it is a subject different from the manufacturer.
How long does the Legal Guarantee last?
The Legal Warranty covers the conformity defects that occur within 24 months from the delivery date of the purchased product, even if at that date the defect was not immediately verifiable. To assert it, the consumer must inform the seller of the defect within 2 months from the date of discovery.
Unless proven otherwise, it is presumed that the conformity defects that occur within the first 6 months from the date of delivery of the goods already existed on that date, unless this hypothesis is incompatible with the nature of the product or with the nature of the defect of compliance.
It is always advisable to keep the purchase receipt of the product, as well as the documents confirming the shipment and delivery of the same.
What rights does the Legal Guarantee provide?
If the purchased product has a defect covered by the Legal Warranty, the consumer has the right, without incurring any costs, to repair or replace the defective product by the seller. The consumer is entitled to the price reduction or to the termination of the contract (i) if the replacement or repair of the product is not possible or is excessively burdensome, if the seller has neither repaired nor replaced the product in a period of reasonable time or if the replacement or repair of the product has caused significant inconvenience to the consumer.
